Welcome to DetailerStack. These Terms of Service ("Terms") govern your access to and use of the DetailerStack platform, including our website, applications, and related services (collectively, the "Services") provided by DetailerStack LLC ("DetailerStack," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Definitions

"Business User" refers to a car detailing business owner or operator who creates a DetailerStack account to use our platform.

"End User" refers to a customer of a Business User who interacts with a DetailerStack-powered website, booking system, or receives communications sent through our platform.

"Your Content" refers to any text, images, data, or other materials you upload, submit, or transmit through the Services.

2. Account Registration

To use certain features of our Services, you must create an account. You agree to provide accurate and complete registration information, maintain the security of your account credentials, notify us immediately of any unauthorized access to your account, and accept responsibility for all activities that occur under your account.

You must be at least 18 years old to create an account. By creating an account, you represent that you are at least 18 years of age.

3. Service Description

DetailerStack provides a software platform for car detailing businesses, including website building, online booking and appointment management, customer communication tools, and business management features. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice.

4. Subscription and Payment

Subscription fees are billed on a recurring basis according to the plan you select. All fees are non-refundable except as required by law. We may change pricing with 30 days written notice. Failure to pay may result in suspension or termination of your access to the Services. If you cancel your subscription, you will retain access through the end of your current billing period.

Payment processing is handled by Stripe. By subscribing, you also agree to Stripe's terms of service. DetailerStack does not store your full credit card information on our servers.

5. End User Payments

Business Users may collect payments from End Users through the DetailerStack platform using Stripe Connect. DetailerStack facilitates these transactions but is not a party to the agreement between Business Users and their End Users. Business Users are solely responsible for:

The services they provide to their End Users
Any refunds, disputes, or chargebacks related to their services
Compliance with applicable tax laws including sales tax collection and remittance
Accurate representation of their services and pricing

6. Acceptable Use

You agree not to:

Use the Services for any unlawful purpose
Upload or transmit viruses, malware, or other malicious code
Attempt to gain unauthorized access to our systems or other users' accounts
Interfere with the proper functioning of the Services
Resell or redistribute the Services without written authorization
Use the Services to send spam or unsolicited communications
Violate any applicable laws or regulations
Use the Services in a way that infringes on the rights of others
Upload content that is defamatory, obscene, or otherwise objectionable

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

7. Your Content

You retain ownership of Your Content. By uploading content to the Services, you grant DetailerStack a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and display Your Content solely as necessary to provide and improve the Services.

You are responsible for Your Content and represent that you have all necessary rights to upload it and that it does not violate any third party's intellectual property or other rights.

We do not monitor or review all content uploaded to the platform, but we reserve the right to remove content that violates these Terms.

8. Intellectual Property

The Services and all related technology, designs, trademarks, and content created by DetailerStack are owned by DetailerStack LLC and protected by intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer any part of the Services without our prior written consent.

Websites built on the DetailerStack platform use our proprietary templates, designs, and code. While you own the content you provide (text, photos, branding), the underlying website structure and code remain the property of DetailerStack.

9. SMS Messaging Terms

Program Name: DetailerStack Appointment Messaging

Program Description: DetailerStack LLC sends transactional SMS messages on behalf of car detailing businesses that use the DetailerStack platform. Messages are sent to end customers who have booked appointments through a DetailerStack-powered website or booking system. Message types include:

Appointment confirmations
Booking reminders
Schedule change notifications
Logistical coordination between the detailer and their customer (such as meeting location details, arrival times, and responses to customer questions)

Opt-In: End users consent to receive SMS messages by checking a clearly labeled consent checkbox during the online appointment booking process on the business's DetailerStack-powered website. The checkbox is unchecked by default and is not required to complete the booking. Consent is not required as a condition of purchase.

Message Frequency: Message frequency varies based on appointment activity. Typical usage is 2-5 messages per booking (confirmation, reminder, and any schedule updates). You will not receive more than 15 messages per month unless you are actively booking multiple appointments.

Message and Data Rates: Message and data rates may apply. Check with your wireless carrier for details about your messaging plan.

Opt-Out: You can opt out of SMS messages at any time by replying STOP to any message you receive from a DetailerStack-powered number. After opting out, you will receive a single confirmation message and no further SMS messages will be sent. Opting out of SMS does not cancel any existing appointments.

Help: For assistance, reply HELP to any message or contact DetailerStack support at support@detailerstack.com.

No Third-Party Sharing: We do not share your phone number or SMS opt-in consent data with any third parties for their own marketing purposes.

Supported Carriers: Major US carriers are supported. Carrier coverage may vary.

10. Privacy

Your use of the Services is subject to our Privacy Policy located at detailerstack.com/privacy, which describes how we collect, use, and protect your information. By using the Services, you consent to the practices described in the Privacy Policy.

11. Third-Party Services

The Services integrate with third-party platforms including Stripe for payment processing, Twilio for SMS messaging, and analytics providers. Your use of these integrations may be subject to those third parties' own terms and privacy policies. DetailerStack is not responsible for the practices or availability of third-party services.

12. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

DETAILERSTACK DOES NOT GUARANTEE THAT WEBSITES BUILT ON OUR PLATFORM WILL ACHIEVE ANY PARTICULAR SEARCH ENGINE RANKING, TRAFFIC LEVEL, OR BUSINESS RESULTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DETAILERSTACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

DETAILERSTACK IS NOT LIABLE FOR ANY DAMAGES ARISING FROM TRANSACTIONS BETWEEN BUSINESS USERS AND THEIR END USERS, DELAYED OR UNDELIVERED SMS MESSAGES, THIRD-PARTY SERVICE OUTAGES OR FAILURES, OR UNAUTHORIZED ACCESS TO YOUR ACCOUNT RESULTING FROM YOUR FAILURE TO MAINTAIN ACCOUNT SECURITY.

14. Indemnification

You agree to indemnify and hold harmless DetailerStack LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, your violation of any applicable law or regulation, any dispute between a Business User and their End Users, or Your Content or any claim that Your Content infringes the rights of a third party.

15. Termination

Either party may terminate the subscription at any time. Upon termination:

Your access to the Services will cease at the end of your current billing period
You remain responsible for any outstanding fees
Your website and booking pages will be taken offline
We will retain Your Content for 30 days after termination, during which time you may request an export of your data
After 30 days, we may permanently delete Your Content

We may terminate or suspend your account immediately and without notice if you violate these Terms, engage in fraudulent activity, fail to pay outstanding fees after notice, or use the Services in a way that poses a risk to our platform or other users.

16. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date at the top of this page. For significant changes, we may also notify you by email. Your continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved in the state or federal courts located in Los Angeles County, California.

18. Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at legal@detailerstack.com. If we cannot resolve the dispute within 30 days of your initial contact, either party may proceed with legal action as described in Section 17.

19. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and DetailerStack regarding the Services and supersede all prior agreements.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it in the future.

Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. DetailerStack may assign these Terms at any time without notice.

Force Majeure. DetailerStack is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, acts of government, internet or telecommunications failures, or power outages.
